Logic behind the decision of the Danish Court

An English translation of the Danish court decision which ruled that a provider shall block its customers from accessing Allofmp3.com has been posted on the Internet.

In short the provider shall block the site as it’s illegal. The site is illegal because music is “offered for very low price on the website as well as …[because of] the information from the Russian branch of IFPI…” Actually IFPI believes that the body which licensed AllofPM3.com should have asked IFPI first. However IFPI couldn’t prove it neither in Russian nor in any other court. It remains unclear what kind of evidence could persuade the Danish court that Russian legislation has less force than information from IFPI.

It is amazing that the Danisch court made this dission even in case of a real illegal webside it is not the provider who has to block because the provider is only a window ore a tool to get into the world wide web and is not responcible for users choices.

But I know people who are realy happy with your side, about to pay some fees for the artist is ok. But all the famous artists are more rich than many important people in the world. I believe when every cd in the world cost not more than 5 ore 7 dollar a piece al the discusion about legal or not legal downloading is away and they sell three times more CD's in the future. I hope finaly you will hold on again the batlle they started to you here in the west. I find out already the other way to pay balance and I will tell to anybody who is interesting in your service.

Your right sf, buying the xrost card thru click & buy is ok, but there is no where on the payment site to put the codes in the refill the balance.

I also absolutely love this website - it's is the most user friendly and contains the best and most content of all of the music download sites. I use XROST with no problems at all. To heck with VISA and Mastercard for folding to what I consider should be illegal attempts to block fair trade! How many fricking castles does Madonna need!!!!!

I believe That if I pay for something I OWN IT not the artist who made it or stars in it, they are trying to stop people from getting cheap music, the same way as they say copying a film that you have bought and own, for your own use, is illegal.

allofmp3.com PAYS MORE TO MUSICIANS! Before listening to mp3 songs, I bought 2 CDs a year = 30€ per year. Looking at my download history, I just found out that I've spent 100€ at allofmp3.com last year!

This is a great site, and I think the prices are fair. You have to consider that you are buying compressed music, not CD quality music (even lossless FLAC isn't really CD quality, just an algorithmic based compression). For compressed audio, the prices are exactly where they should be, and the RIAA needs to recognize this. If I was buying a CD, I would certainly expect to pay more, but I'm not.
The RIAA has been screwing musicians (and us) for so long that they get offended if we even ask for some cuddling afterwards.

TAE - FLAC is lossless - it should be the SAME as CD source barring any digital extraction errors. If you burn a CD with FLAC source files, it will be the same as the original CD.

Lossless = no loss.

How about making a way to donate some money to the artists through allofmp3.com? Voluntarily of course!

I would be happy to have a setting in my account where I could say, e.g. that a 50% surplus charge should be taken from my account and given to the artist.

Or a way to later (after listening to the music) to go back and donate some money to the artists that I downloaded.

This might also open the IFPI's eyes to that allofmp3.com is a great service to music lovers _and_ a good way for artists to promote their music and at the same time earn money.

I have a feeling most of the posts above are by fairly young people. I am not young nor am I old. I have been a radio DJ for year and music fan for life and am friends with many musicians. Two comments to make, not specific to allofMP3, but in general. One, with the high price of CDs today to pay the expense of the labels (not the artists) their is hardly any way for young folks on a limited budget to obtain music. Two, the music I download is from musicians who I would never buy their CD and pay the store costs but if I download a CD, listen to it, like it I am telling people about it and may even buy a CD of theirs in the future. Without cheap and easy access, I would never have known and/or cared about the artist. It is NOT the musicians who care. They are artists and enjoy their music being shared and spread, for the most part. It is the record companies. Who is filing the lawsuits? Not the artists. Support independent record labels. Boycott the major labels. Better music on indy labels anyway. Instead of attacking the internet, the Attorney Generals should attack the record companies for price gouging.

All that said, I DO hope allofMP3 finds a way to pay the artists directly. Contact BMI and ASCAP in the US and I am sure there is a way to bypass the record companies and still support the artists.

Personally and I'm far from well off currently however I still wouldn't mind aomp3 raising their prices to settle all of this bs and get back to expanding the catalog. I'm not talking itune$ money, but come on this shit is dirt cheap..... don't kid yourself, the artists are not being compensated by aomp3. Hands down this is the best that I know of for downloading nonprotected files in the largest array of ways. It doesn't get much better. bank your balance and grab what you can now 'cause this aint going to last. PS: Compensating artist direct will never work....... artist are artist.... let them make the music and the lawyers fight over the cash. I'll jump through a few loops to refill my balance....... but I'm tiring. Peace and hair grease, mo fo's.

Hmmm. It is just a question of time, before traveling to eastern countries for western countries are banned by demand of e.g. Jack Daniels or Carlsberg Breweries because their products are sold to a compared lower price as in the western markets... The descision made by the Danish Court seems not to regard the different economics. If the descision should have any hold in the real world, the monthly payroles in Denmark an Russia should be a like - but as far as I'm concerned, they are not....

I believe the real problem is that the artists are obliged to at percentage fee from the sale, and that a percentage of 2 dollars are not as fun as the same percentage of 20 dollars..

That is a fact.

I won't buy 'shop' CDs or pay 'huge' download prices on principle. I complained for over 10 years that consumers were being ripped off by the music industry, charging 15 quid or more for a chart CD. The industry laughed at us gullible fools then, whilst they filled their very deep pockets with our money. Suddenly, because we have alternative methods of procuring music, they can apparantly still make massive profits selling CDs for 6 quid!! Too little too late as far as I'm concerned. They can stick their DRM where the sun don't shine!

I buy from here purely because it is not the consumers liabily to establish whether a company complies with the law before they purchase. Therefore, unlike file sharing, for which someone may be prosecuted, allofmp3 is a cheap 'peace of mind' service for the consumer.

Most times when I go in, a big bullyin jobsworth will confiscate my booze whilst givin me a big conceited smile. I class that as stealing, and so I try to assume the same conceited smile whilst I download their music. As we say in the UK, What's good for the goose........!!!

To all those who says Allofmp3 is illegal: I dare you to show me a cout ruling stating it is illegal. As far as I remember, a russian court has ruled it legal, and the danish minstry of culture has officially stated that as long they haven't been judged illegal in Russia, danish consumers can buy from the site legally when they are in good faith. Furthermore they said that IFPI stating it is illegal to download for AOM is illegal, isn't enough to put the consumers in bad faith.

The fact remains that there is a wide spectrum of possible legal interpretations of intellectual property law (as seen by the wealth of various positions on music downloads from country to country), and allofMP3's stance is to put the decision whether to use or not to use its services squarely in the hands of those who should be able to decide: the *individual consumer*. Also, allofMP3's management has referred to the attempts to render royalties to the representatives concerned who are complaining so loudly about not getting their money -- only to be told, in effect, "we don't want your filthy lucre". So what is allofMP3 to do? Should the company be bullied into joining forces with an organization that insists on 'my way or the highway' -- which would also lock out many Russian music lovers (not to mention many others who are not made of money) because of the discrepancy in wages there compared to the West?
What I think is particularly disgusting in this regard is that VISA International has decided *for* us -- due to the lobbying on the part of the Recording Industry Association of America -- that their card -- which card-carriers normally pay good money for in annual fees -- cannot be used to purchase music on the site. What's next? Will buying products at shops known to cater to same-sex couples, for instance, be prohibited by VISA because some interest group declares homosexuality worthy of censure, something that should be illegalized at all costs?

Regardless of the decision of the Danish court I am in full support of All of MP3. Current music prices have grown to the point of ridiculousness and I as a student would not be able to afford it. Listening to music is an integral part of my day, my thanks to All of MP3 for keeping it that way.

Luckily it is easy to bypass the ISP Tele 2 block of Allofmp3. Just change the DNS server to any other ISP.

Allofmp3 should fight back by adding a Danish top 20 chart to the list of national charts.

Well I'm sure most people realise who, in the main, controls the media companies. They seem to have an undue influence on the law makers at the very highest levels. They appear to have mastered the art of playing the victim and getting everything the squeal for whilst activities such as wars, violent crimes and environmental destruction pass by with little regard. Get a sense of proportion you greedy oligopolies and realise what is truly important to most people in our world. Stop being obsessed with gathering even more wealth and spread a little love!

I was just wondering if it could conceivably make any difference if those who feel that allofMP3.com has the right to survive were to write a letter to VISA protesting the fact that the card issuer has cancelled its agreement with the company. Yes, as a mega enterprise they can make any decision they wish as to who they want as card-carriers or affiliated enterprises. But ultimately if their customer base is eroded due to practices regarded as unfair or questionable, it also affects the corporation's bottom line. Writing a message does not require revealing your identity if you prefer anonymity. And it can also be done online here:

Also as a matter of principle, I think we should have the choice of deciding which businesses are legitimate *ourselves* rather than have a credit card company decide this on our behalf (especially when it is an interest group which inveighed against VISA to take this action). Where I live, there is no objection to the activities of allofMP3, yet VISA has decided -- on my behalf -- that the company's operations are illicit. Personally, I'll be sending just such a message of protest about this today.

Just on contacting VISA, I note that Visa International's website does request a name and email address. 'Name withheld' is possible, but the email address is a little more difficult. Of course, one can choose an email address from a wide variety of various sources which can also protect anonymity. But sorry, I didn't realize till getting further into the process that VISA wants such details.

Hmmm, as I remember, just in the beginning of the AOMP3 service many years ago there was a possibility to pay via PayPal (it was not an Ebay daughter company then). Actually, that's how i got to PayPal then. However, in a couple of months the PayPal service was turned off (i still wonder why), but anyway, that was a long time ago already. Nowadays, using PayPal to refill ones account on AOMP3 would be senseless IMHO, since one has to register the same bloody VISAs and MASTERCARDs on PayPal, which would not allow for the transaction in the light of the recent events bewteen VISA/MASTERCARD and AllofMP3.com. On the other hand, i think there is a possibility (since a year or so) to refill your PayPal account directly thru one's bank account (you know, by registering your IBAN/BIC or SWIFT with PayPal). As I understand, this is then quite a possibility to avoid interfering of the Credit Card assholes with your AOMP3 payments. If what I'm thinking is true, then I guess Allofmp3 guys should really consider putting back PayPal service on track!

A: Unfortunately, we cannot process international money transfers according to currency regulation rules in Russia. For the same reason, we also do not accept Western Union and other money transfers.



Hmmm, it seems like they turned off PayPal due to insufficiency in the Russian Law. But as I've read above, the Xrost service works... I dunno... Never used it, maybe it's a different system...

Xrost does work - you join their website, then join click and buy (from within Xrost). Set up visa account with click and buy. Then back in Xrost buy your card, get the pin number, go to MP3 and input Xrost pin and there you go - simple.

If you want your music like I did, you'll have to jump through these hoops, but it does work.

I bought Genesis 'Trespass' in 1971 on vinyl. Now I want to listen to the same music on my Creative mp3 player. Gabriel & friends have already got their money. Why the f**k shouldn't I download 'Trespass' from this site, paying an acceptable fee? I shall not pay the artist or record company twice to enjoy what I have legally paid for! Damn!

Allofmp3 is a movement and a cause worth fighting for! What we are experiencing right now is the established music industry doing everything it can to AVOID change! The power will be in the consumer's hands in the future, this is only the beginning. Allofmp3 is the what buying and listening to music should be. Napster died and came back as a watered down, distant cousin of itself. We mustn't let this happen to allofmp3! Entrance into the WTO for Russia! And freedom for allofmp3!

Just to add , in case anybody dubious about using x-rost/click and buy-It took me 5 mins to set up account on their site, and have refilled balance twice over last week.Once youve logged details into x-rost site the only additional work is to open a second browser page to make it easier to fill in codes in spaces provided back at refill page, otherwise as quick and automatic as before.Visa and Mastercard are thus irrelevant.
As mentioned , if youre worried about spam, just set up yet another disposable email account with hotmail or yahoo, again takes 5 minutes.(you mean you havent already got a few!!). But WHILE I'm here-
Its only a question of time before every house in the country will have a collection of mp3 libraries that is as big as AllOfMP3's, especially by the time that portable hard drives are even smaller and everybody has swopped files with everybody else-this can be slowed down, but its inevitable, and the current attempts to control access will in the future look as quaint as chaining Bibles in Latin to pulpits, to keep the plebs in their place, or everyone sitting around the wireless, or saving up pennies to buy the latest 45.
Incidentally,it seems to me that there's now so much freely available music ,there isnt REALLY any need to BUY any- I also record and edit streamed etc. internet radio, via Audiohijack or similar and transfer to Archos mp3 player or cd- good quality and lots of it-I mean do you really need. to get the current 'top 20" or whatever immediately, or a complete album , (handy though Allof Mp3 is, especially for back catalogues,). and STILL havent the time to listen to it all!
In other words, if you get sucked into Windows/Visa/I-pod/I-Tunes Store, they,ll force you to comply more to their needs, not just to yours. Anybody paying more than Allofmp3 prices for music must have more money than sense,but then so what's new! .... ( dont get me started on the upcoming Vista farce!- watch your pennies!) I think the music companies are of course aware of all this, so you cant blame them for trying to drag it out as long as possible; but theres new markets to move on to anyway; soon theyll have you thinking that just LISTENING to music via headphones is so passe without a whole 3D experience to accompany it plugged into your brain.(licensed via eyeball recognition and has to be renewed annually, or youll never have virtual sex on the dvirtual dancefloor again) Meanwhile, for the time being, let us be grateful to dubious Russian entrepreneurs, bless'em!

As a consumer, I'm not sure where I stand on the whole pricing/profit issue - as a DJ, I reckon the artists do alright out of me promoting their music to 1000s of people each week. More to the point, ALLOFMP3 is frickin invaluable to me for the simple fact I can download 320kbps-quality mp3 for playing out. Any lower quality just won't do (for me anyway - others disagree/can't tell the difference). I can even download the original WAV for a few more pennies. Absolutely stunning - I wish I'd discovered it sooner...

If itunes or anyone else offered hi-quality mp3s or wavs, I would have no problem paying 79p for a track. As it stands, 79p for a 128kbps mp3 is sickening, and for that they deserve to lose business.
So, although ALLOFMP3 is amazingly cheap, for me it is a question of sound quality and they get much credit for having the nous to offer it to me.

I've tried nearly everything to fill up my balance but every way seems to be blocked. I'm really frustrated because the only site that lets the costumer decide what he wants (bitrate, decoding type) seems to be too successfull and the greedy pack (iTunes, Musicload and others) do their usual bullying to keep THEIR profits (who cares for the artists…)

Thanks for the info, drinian and others who have posted good info on alternate payment methods.

I'll try to refresh my account and if I lose the money, oh well - it was great while it lasted.

I've been in the recorded music biz for over 30 years.
I pay a license to make custom compilations (not legal for sale, which I do not do).
I also pay a royalty of 21 cents per disc, to compensate the record companies for lost "music" royalty revenue, even though my recorded disc may only contain backup data, or original recordings.

Here are my main complaints:
- A new artist will often lose money on the golden "recording contract" with a record label, due to production costs, recording costs, promotion costs, etc. It will often lead the artist into bankruptcy.
- I heard a major, world-wide promoter/agent, say that he does not care about unsigned artists - only those that are signed to a label.
- I've have several associates (composers and musicians) that have recorded material that received public, commercial, airplay.
- To a word, they all said that it all depends on their luck. If ASCAP, BMI, SOCAN, etc do a "sweep" when their song is being broadcast, they may get a small royalty cheque. Otherwise, forget it.
- The RIAA is just a political, lobbyist arm of the various record labels. The "henchmen", so to speak.
- The major media players contribute huge sums to political hopefulls.
- The world-wide media companies have "very" deep pockets.
- I'm somewhat surprised that they would challenge a legal Russian enterprise, when the Asian markets are the worst for patent/trademark/royalty/infringement. (Before this gets out of hand in a social commentary - my parents are Ukranian/Russian decent. Some of my closest friends are Asian). Some people (regardless of origin) are just REALLY smart!
- I always appreciated that AOMP3 allowed a very low bit-rate preview of a song. I thot it was ingenious! Why don't the record companies do that? Allow a free, low-grade song that can be downloaded to an i-pod. If one really likes the song, then BUY the song!! - I am concerned about the direction that AOMP3 is taking, regarding their high-quality, restricted download service. However, they have a business model to protect and I would not blame them for their fight for survival.
- AOMP3 has actually increased my spending on commercial CDs. I may download (and pay for)a song that peaks my interest. If I like it, I may preview the entire CD. If I like the entire CD, I will but a retail stamped (not burned)copy. There is much controversy that most CD-R discs are subject to failure within a relatively short period of time (5 to 10 years). If interested, I can post a link to the most recent discussion of this subject.

In summary, I think that AOMP3 is fighting a losing battle.
And, we'll all have to pay the price.
(Or... spend more $$ for our downloading service).

I love these guys. They had (have)everything right.
Sometimes, you just can't fight city-hall.
I respect their intelligence, ability and marketing strengths.

What a paradox!!

I have spent over $100 on music since finding AllofMP3. I never spent this much before. As a result of the preview full album option and the recomendations of similar artists, I have branched out, and now listen to bands I would have never heard or, including some great Russian, German and French bands/artists.

This is a way to do it, provide more income for the artists = the artist will support AllofMP3.com Then it's the record industry against the wishes of the artists.

Now for the juicy part, allofmp3.com should support more unknown artists, support meaning promoting them and paying them more than the record companies. Then allofmp3 should start attracting well known artists. It's all about the money. Put the pressure on the record industry by using the people that make the record companies money = the Artists themselves.

Allofmp3 can be the next Wallmart of music.

I have never bought a new CD, Just to expensive, I buy used CDs at a fraction of the cost. I buy last years new unopened software and then get the free upgrades. I believe if the CDs didn't cost so much, the record industry would make much more money. Reminds me of the drug companies.

As you might know form a hectic situation last year around some drawings, the freedom of press is very sacred here, but it is subject to law. What CW is doing is known as slander which is under criminal law, and it is also knowingly printing false articles which is punishable according to the press law.
